By using this website you agree to these terms and to our privacy notice, which explains how we handle personal information. If you do not agree, please do not use the site. You must be at least 18, or the age of majority where you live, to send us an inquiry or use the assistant.

If you have a signed agreement with us for services, that agreement controls if anything in it conflicts with these terms.

Using this site

You may use this website to learn about us and to contact us. You agree not to:

• use the site in a way that breaks the law or infringes anyone's rights;
• send spam, false information, or content that is abusive, threatening or harmful;
• try to get around the bot check, rate limits or other security measures, or to access parts of the site or our systems that are not meant to be public;
• upload or send malware or anything designed to disrupt the site;
• copy or scrape the site in bulk, except by search engines and similar services that follow our robots.txt file;
• pretend to be someone else, or misrepresent your connection with any person or business.

Our content

The text, design, graphics, code and other content of this website, and the Beta Gen Studios and Beta Gen Technologies names and logos, belong to us or to those who licensed them to us, and are protected by copyright and trademark law.

You may view the site and print or save pages for your own use, for example to consider working with us. You may not copy, publish or reuse our content for other purposes without our written permission.

Our clients' work

Our work pages show websites and other projects we created or worked on for clients, as examples of our work. The clients' websites, names, logos, photos and other materials belong to those clients or to their licensors. Showing them here does not transfer any rights to you, and it does not mean a client endorses anything beyond the work we describe.

We describe each project as accurately as we can. Live client websites can change after our work ends, and they are run by the clients, not by us. If you own something shown on our site and want it changed or removed, contact us and we will review your request promptly.

Using our AI assistant

The assistant is an automated AI program, not a person. It answers from the content of this website, and its answers can be incomplete or wrong. Check anything important with our team before you rely on it.

The assistant cannot give quotes, prices, timelines, availability, guarantees or commitments, and nothing it says is an offer or binds us. It does not give legal, financial, tax, medical or other professional advice.

If you want our team to contact you, the assistant collects your details in the chat and shows you a summary. Please check it before you press “Send to the team”: only that button sends your inquiry. The assistant's note to our team on whether an inquiry looks like a fit is an internal aid. It does not decide whether we will work with you, and a person on our team reads every inquiry that is sent.

Conversations are recorded and may be read by our team, as explained in the notice before the chat and in our privacy notice. Please do not share sensitive personal information or confidential business information in the chat.

When you use the assistant, you also agree not to try to make it ignore its instructions, reveal how it is set up, or produce content unrelated to our services, and not to use automated tools to send it messages. We may limit, pause or end any conversation, and change or turn off the assistant at any time.

Inquiries, quotes and bookings are not contracts

Sending an inquiry, chatting with the assistant or booking a call does not create a client relationship or any obligation for either of us. Descriptions of services, examples and approaches on this website are general information, not offers.

Every project is scoped and quoted individually. Prices, timelines and other terms apply only once they are set out in a written proposal or agreement that we have both signed.

What you send us

When you send us information through a form, the assistant or email, you confirm that it is accurate and that you have the right to share it. You allow us to use it to respond to you and to consider working with you, as described in our privacy notice.

Please do not send confidential information or trade secrets before we have both signed a confidentiality agreement. Until then, we cannot accept a duty to keep unsolicited ideas confidential, and we may already be working on similar ideas ourselves or for others.

Links and third-party services

This website links to other websites, including our clients' live sites, and uses third-party services such as the Cloudflare bot check and the Google Calendar booking page. We do not control those sites or services and are not responsible for their content, availability or privacy practices. Their own terms and privacy notices apply when you use them.

Copyright complaints

We respect the intellectual property of others. If you believe something on this website infringes your copyright, email info@betagenstudios.com with “Copyright complaint” in the subject and include:

• the work you believe is infringed, and where it appears on our site;
• your name, address, phone number and email address;
• a statement that you believe in good faith that the use is not authorized by the owner, its agent or the law;
• a statement that the information in your notice is accurate and that you are the owner, or are authorized to act for the owner;
• your physical or electronic signature.

Disclaimers

We work to keep this website accurate and available, but we provide it “as is” and “as available.” To the fullest extent the law allows, we make no warranties about the website, the assistant or their content, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that the site will be uninterrupted, error free or free of harmful components, or that any result described on it will be achieved for you.

These disclaimers apply to this website only. Warranties for client services, if any, are set out in the signed agreement for those services.

Limitation of liability

To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from your use of this website or the assistant, even if we were told they were possible. Our total liability for any claim arising from your use of this website or the assistant is limited to one hundred US dollars.

These limits do not apply to liability for our gross negligence, willful misconduct or fraud, for personal injury caused by our negligence, or to anything else that cannot be limited under applicable law. They do not change any signed agreement for services.

Your responsibility

If you misuse this website or the assistant, or break these terms, and that leads to a claim against us by someone else, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows.

Governing law and disputes

These terms are governed by the laws of the Commonwealth of Virginia and applicable US federal law, without regard to conflict of law rules.

If you have a concern, please contact us first. Most issues can be settled informally, and we will try in good faith to do so within 30 days. If we cannot, any lawsuit about this website or these terms must be brought in the state courts located in Henrico County, Virginia, or in the United States District Court for the Eastern District of Virginia, Richmond Division, and you and we agree to the jurisdiction of those courts. This does not take away any right you have under the consumer protection laws of the place where you live that cannot be waived by agreement.

Changes to these terms

We may update these terms from time to time. The effective date at the top shows when the current version took effect. Changes apply from that date to later use of the website. They do not apply to a dispute that arose before the change.

General terms

If any part of these terms cannot be enforced, the rest stays in effect. If we do not enforce a term right away, we have not waived it. These terms and our privacy notice are the whole agreement between you and us about using this website, and you may not transfer your rights under them. We may transfer ours as part of a sale or reorganization of our business.
